Terms of Service

1. Agreement and Authority

By accessing or using Contour Digitizer ("Service"), you agree to be bound by these Terms of Service. If you are accepting these terms on behalf of a company, employer, or other legal entity, you represent and warrant that you have the full legal authority to bind such entity to these terms. If you do not have such authority or do not agree with these terms, you must not access or use the Service.

2. Description of Service and Professional Responsibility

Contour Digitizer is a data-extraction aid designed for engineers to extract numerical values from Finite Element Analysis (FEA), Computational Fluid Dynamics (CFD), Thermal Analysis, or other contour analysis plots. You acknowledge that the Service is provided as a supplemental tool and is not a substitute for professional engineering judgment, peer review, or independent verification.

You assume all responsibility for the accuracy, safety, and legal compliance of any engineering designs, decisions, or certifications made using data derived from the Service. While we strive for mathematical accuracy in our color-to-value mapping, you are responsible for verifying all output data; do not rely solely on this tool for critical engineering decisions or life-safety applications without independent validation.

3. Intellectual Property, Copyright, and Trademarks

The Service, including but not limited to its "Contour Digitizer" name, logos, domain names, source code, scripts, graphics, user interface design, and original documentation, is the exclusive proprietary property of Contour Digitizer and is protected by United States and international copyright, trademark, and other intellectual property laws.

Your use of the Service grants you a limited, non-exclusive, and non-transferable license to access the tool for its intended purpose; it does not transfer any ownership or interest in our intellectual property to you. You are strictly prohibited from removing, hiding, or altering any proprietary notices, legends, or trademarks contained within the Service.

You shall not, and shall not permit any third party to, decompile, disassemble, reverse-engineer, or attempt to derive the source code of the Service. Furthermore, you are prohibited from using the Service for the development of competing software products, or for publishing comparative benchmarks intended to disparage the Service, without prior written consent.

4. Local Processing and Data Safety

All image processing occurs entirely within your browser's local environment. Uploaded images and sampled pixel data are never transmitted to our servers or any third party. While we do not store your data, you represent and warrant that you will not use the Service to process data restricted by:

• The International Traffic in Arms Regulations (ITAR)
• The Export Administration Regulations (EAR)
• Controlled Unclassified Information (CUI)
• Naval Nuclear Propulsion Information (NNPI)
• Any other type of sensitive, proprietary, or government-controlled data

...without appropriate authorization. You agree not to include any such restricted data in support inquiries sent via email. You acknowledge that you are solely responsible for ensuring that your use of the Service complies with all applicable local, state, national, and international laws and regulations.

5. Limitation of Liability and Indemnification

You agree to indemnify, defend, and hold harmless Contour Digitizer from any loss, cost, or damage, including attorney's fees, arising out of your use of the Service or your breach of these terms.

In no event, whether in contract, tort (including negligence), or any other legal theory, shall Contour Digitizer be liable to you or any third parties for any direct, indirect, incidental, special, punitive, or consequential damages, including but not limited to engineering errors, miscalculations, loss of data, loss of revenue, business interruption, or the cost of procurement of substitute goods.

Notwithstanding the foregoing, if a court of competent jurisdiction finds Contour Digitizer liable for any reason, you agree that our total aggregate liability for all claims, damages, and causes of action shall not exceed the amount of one hundred dollars ($100.00). You acknowledge and agree that Contour Digitizer is providing the Service free of charge, and that the $100.00 cap and the total waivers above are essential elements of the basis of the bargain between you and Contour Digitizer; without these limitations, the Service would not be made available.

6. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States. Any disputes arising from these Terms or your use of the Service shall first be addressed through good-faith negotiation. If unresolved, disputes shall be settled through binding arbitration in Brevard County, Florida. You agree to waive any right to a jury trial or to participate in a class-action lawsuit.

7. Changes to Service and Terms

We reserve the right to modify or discontinue the Service, or update these Terms, at any time. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

8. Pricing and Refunds

The Service is currently provided free of charge during our validation phase. Should we introduce paid features in the future, pricing and payment terms will be clearly displayed on our pricing page prior to any purchase.

9. Acceptable Use

You agree to use the Service only for lawful purposes. You agree NOT to:

• Use the Service in any way that violates applicable laws or regulations
• Upload malicious code, viruses, or attempt to compromise the Service
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated systems (bots, scrapers, crawlers) without written permission
• Resell, sublicense, or commercially redistribute the Service
• Use the Service to harass, harm, or impersonate others
• Interfere with or disrupt the integrity or performance of the Service
• Circumvent any usage limits, feature restrictions, or licensing controls
• Use the Service to process content that infringes third-party intellectual property rights

10. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance or updates
• Technical issues, server problems, or network outages
• Third-party service disruptions (hosting providers, etc.)
• Circumstances beyond our reasonable control (force majeure)

We are not liable for any losses, damages, or missed deadlines arising from Service unavailability. For mission-critical engineering work, we recommend maintaining alternative tools and workflows.

11. Termination

You may stop using the Service at any time. We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, if you:

• Violate any provision of these Terms
• Engage in fraudulent, abusive, or illegal activity
• Use the Service in a manner that may harm us, other users, or third parties
• Are required to be terminated by law or court order

Upon termination, your right to use the Service will immediately cease. The provisions of Sections 3 (Intellectual Property), 4 (Local Processing and Data Safety), 5 (Limitation of Liability and Indemnification), 6 (Governing Law and Disputes), and 12 (Severability and Entire Agreement) shall survive termination and remain in full force and effect.

12. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, invalid, or illegal by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy constitute the entire agreement between you and Contour Digitizer regarding the Service, and supersede all prior agreements, understandings, or representations, whether written or oral.

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
